Welcome to FableNow. We create magical, personalized AI-generated storybooks and video greetings in which your child becomes the hero of their own adventure. Each book and greeting is custom-made using artificial intelligence, incorporating the child's name, appearance, and the personal details you provide. Books are available as an interactive digital edition (flipbook + PDF) and, optionally, as a printed keepsake delivered worldwide.

This website (fablenow.com) is owned and operated by HAPPYGLOBAL LLC ("FableNow", "we", "us", "our"). By accessing our website, placing an order, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use our services.

Definitions

"Buyer", "Customer", "you" — the person placing an order or using the Website. "Content" / "Submissions" — photos, names, and information you provide. "Order" — a request for a digital book, printed book, narration, or video greeting. "Product" — the personalized book or greeting we deliver. "Website" — fablenow.com and related services. "We" / "Company" — HAPPYGLOBAL LLC.

Acceptance of Terms

By using our services you confirm that you are at least 18 years old (or have the consent of a parent or legal guardian), that you have the legal authority to enter into this agreement, that the information you provide is accurate, that you have read our Privacy Policy, and that you will use the services in accordance with these Terms.

Order Fulfillment and Completion

Digital products: once the digital book or video greeting has been generated and made available to you (accessed, viewed, or downloaded), the Order is deemed fulfilled and the digital product has been delivered in full. Printed products: an Order for a printed book is fulfilled once the book has been produced and handed to the carrier for shipment. Because each Product is personalized and made to order specifically for you, it cannot be resold to anyone else.

AI-Generated Content

Our Products are created using artificial-intelligence algorithms. Because of the nature of AI generation, minor variations in appearance, text, or illustration may occur between orders, and the result is an artistic interpretation rather than a photographic reproduction. You understand that characters depicted are fictional and stylized.

Intellectual Property & License

All characters, artwork, software, trademarks, and other content of the Website belong to HAPPYGLOBAL LLC or its licensors. Upon full payment, you receive a limited, non-exclusive, non-transferable license to use the personalized Product you ordered for your own personal, non-commercial use. You may not resell, redistribute, sublicense, modify for commercial gain, remove watermarks from, or otherwise commercially exploit the Products without our written permission.

Prices and Payment

Prices are displayed in your local currency or in US dollars and may include or exclude taxes depending on your location; applicable taxes are calculated at checkout. Payments are processed by third-party payment providers (including Stripe); we do not store your full card details. We may change prices at any time, but changes do not affect Orders already placed. Promotional codes and discounts are subject to their specific terms and may be withdrawn at any time.

Delivery

Digital books and video greetings are generated shortly after payment and made available in your account; generation usually takes a few minutes but may take longer at peak times. Digital files and viewer links remain available for at least 12 months. Printed books are produced and shipped through our print partners; production and worldwide shipping times vary by destination and are shown at checkout. You are responsible for providing an accurate delivery address and for having a compatible device and internet access to view digital Products.

Refunds and Corrections

Because Products are personalized and made to order, the statutory right to cancel does not apply once production or generation has begun, to the extent permitted by law. We will, however, provide a correction, replacement, or refund where a Product was not delivered, contains a technical defect, arrives materially damaged, or differs substantially from your Order. Corrections (for example a wrong photo, a misspelled name, or a missing segment) are available on request. Refunds are generally not provided for successfully delivered digital Products or for minor AI variations. Printed Products damaged in transit are replaced upon photographic evidence. Your Responsibilities

You confirm that you own, or have permission to use, every photo and piece of personal information you submit, and that you have the right and authority to use the likeness and details of any child depicted. You must not submit content that is unlawful or infringing, or that depicts a child without the consent of their parent or guardian. You must not use the Products for any illegal or inappropriate purpose.

Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to a Product or these Terms is limited to the amount you paid for the specific Product giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, loss of profits, or for misuse of a Product by you or any third party.

Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. The parties will first attempt to resolve any dispute informally within 30 days. Any unresolved dispute will be settled by binding arbitration administered by the American Arbitration Association before a single arbitrator, seated in Delaware or conducted remotely. You agree to bring claims only in your individual capacity and waive any class action; any claim must be brought within one year.

Prohibited Activities

You may not: use automated systems to access the Website, attempt to gain unauthorized access, interfere with or disrupt the services, circumvent security measures, impersonate others, upload malicious code, harvest data, resell the Products, or use the services in violation of any law.

Indemnification

You agree to indemnify and hold harmless HAPPYGLOBAL LLC from any claims, damages, or expenses arising out of your use of the services, your violation of these Terms, your violation of any third-party rights, or the content you submit.

Email & SMS Communications

We send transactional messages (such as login codes, order confirmations, and "your book is ready" notifications) by email and, where you provide a phone number, by SMS. By providing your phone number you consent to receive such transactional messages; you may opt out at any time by replying STOP. We do not send promotional SMS without separate consent.

Data Protection & Children's Privacy

We process personal data in accordance with the GDPR, UK GDPR, and CCPA, as described in our Privacy Policy. Photos you upload are used solely to generate your Product and are deleted within 90 days; we never sell personal data. Our services create books and greetings FOR children but are purchased and operated BY adults; we do not knowingly collect personal information directly from children.

Termination

We may refuse service, suspend or terminate accounts that violate these Terms, cancel Orders we reasonably suspect to be fraudulent, and modify or discontinue any part of the services at any time.

Disclaimer of Warranties

The Website and the Products are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that an AI-generated result will meet any expectation beyond the description of the Product you ordered. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

Electronic Communications

By using the Website you consent to receive communications from us electronically (by email or on-site notices), and you agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that such communications be in writing.

Third-Party Links & Services

The Website may link to, or rely on, third-party websites and services. We are not responsible for the content, policies, or practices of any third party, and your use of them is at your own risk and subject to their own terms.

Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, civil unrest, strikes, internet or hosting outages, or the failure of payment, AI, printing, or shipping providers, or changes in applicable law.

Assignment, Waiver & Entire Agreement

You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign ours to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and HAPPYGLOBAL LLC regarding the service and supersede any prior agreements on the same subject.

Severability & Changes

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect. We may update these Terms from time to time; the current version is always posted here, and significant changes will be communicated by email or a prominent notice on the Website. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
